General Term “Home of Pasta” trip competition
These terms and conditions (hereafter the “General Terms”) are the terms and conditions that apply to the competition promoted by AllTaster LTD, a company registered in England and Wales with a company number 11790017 and with its registered office at WeWork, 1 Waterhouse Square, EC1N 2ST, (hereafter “Taster” or the “Promoter”) is the promoter of the prize draw. You can write to us at this address if you have any concern in relation to our Competition, setting out clearly (i) the name of the Competition, (ii) the name of our publication or website running the Competition and (iii) your issue.
The Competition
The purpose of the competition (hereafter the “Competition”) is to win a trip to Florence, Italy, the “Home of Pasta”. The Competition is running on the Jamie Oliver and Pasta Dreams Instagram channel.
Entry and Prize Draw Methods
The prize draw (launch on 09/03/23) is a competition for residents of Europe aged 18 and over, with the exception of Taster’s employees, their immediate families or anyone professionally connected with the promotion. We reserve the right to disqualify any entry which does not comply with these General Terms.
By entering the prize draw, entrants will be deemed to be bound by and have accepted these prize draw terms and conditions. The prize draw opens on the 09/03/23 at 09:00am GMT and closes on the 28/04/23 at 23:59pm BST (the “Competition Period”). The prize draw will take place on the 03/05/23.
To participate in the Competition the entrants must like the competition social post and tag another Instagram account in the comments of the post in the Competition Period For valid entry, entrants must also be following the Pasta Dreams Instagram account (@pastadreams) and Jamie Oliver Instagram account (@jamieoliver) in the Competition Period. The competition social post will be posted on the Jamie Oliver Instagram account (@jamieoliver) and the Pasta Dreams Instagram account (@pastadreams) on 9th March 2023. Engagement with subsequent posts in relation to the competition will not be considered a valid entry. Entries made outside the Competition Period will not be valid. No purchase is necessary. Entry to the draw is free.
Only one entry per person. Bulk entries from trade, consumer groups or third parties will not be accepted. Multiple entries made by the same person from various email or other accounts will not be accepted.
The Winner
The prizewinner will be drawn at random by Taster and overseen by an independent adjudicator using https://commentpicker.com/. The winner will be notified privately by direct message on Instagram by 08/05/23 latest. Once Prizewinners are contacted by direct message on Instagram, they will liaise with Taster for the booking of the prize. Taster’s decision is final and no correspondence will be entered into. Winners’ names are available on request by emailing [email protected].
Taster reserves the right to request proof of a prizewinner’s identity in the form of a passport or driver’s licence and proof of address in the form of a utility bill. In the event that a prizewinner cannot provide us with proof of identity reasonably acceptable to Taster, Taster may withdraw the prize and select another prizewinner.
The Prize
Entrants and their guest must be 18 or over at the time of entry.
One (1) entrant drawn at random will receive the Competition prize of “Pasta Dreams Dream Trip to Italy”, up to a total of £4,000, including:
- Flights to Florence for two people [Friday – Sunday]
- Two nights in a 4* hotel for two people [Friday – Sunday]
- Two dinners for 2 people, picked from a list of Jamie’s recommended restaurants
- Colle Bereto Chianti wine tour, tasting, cooking class & lunch for two people
(1) Flights will include two x economy class tickets with luggage allowance of 1 checked in bag each, travelling together from the winners’ closest airport to Florence (Aeroporto di Firenze-Peretola) departing on Friday and returning on Sunday. Transfers from home to airport not included. Travel is not permitted over Christmas, New Year, Easter, Bank Holidays (UK & Italy), trade fairs or local special events (i.e. Fashion Week / Sporting Events). All travel must be completed within the time-frame stated in the promotional terms. Transport between your home and the departure airport is the responsibility of the winner. Extensions to the validity of the package will not be allowed. Flights will be booked by Taster and paid for in advance, included in the total maximum prize value of £4,000
(2) Accommodation for two people will be booked at a 4* hotel, at the discretion of the prizewinner, in conversation with Taster, comprising Friday night and Saturday night. Any additional charges (food, drink etc) incurred at the accommodation will be covered by the prizewinner. Accommodation will be booked by Taster and paid for in advance, included in the total maximum prize value of £4,000.
(3) A list of recommended restaurants will be provided to the prizewinners and reservations will be made by Taster. Where possible, restaurants will be prepaid by Taster at £75pp per meal (up to the max value of £300). In the event that the restaurant cannot take prepayment,
the prizewinner will be responsible for paying for dinners out using money provide by Taster via bank transfer. Any costs cover the £75pp per dinner will be covered by the prizewinner. Transfers to the restaurants are not included.
(4) The Colle Bereto Wine Tour, Tasting, Cooking Class & Lunch experience is approximately 3-3.5 hours long with a flexible start time. The experience includes a tour of the wine cellar and vineyard visit, pasta-making cooking class, wine tasting and three-course lunch. The trip will be booked and paid for in advance by Taster. Transfers are not included and must be arranged by the prizewinner.
Unless otherwise stated, the prize must be taken within six (6) months of the closing date of the relevant Competition or the prize will lapse. Taster must be given a minimum of 8 weeks’ notice when booking flights and accommodation. The prizes are as stated and there are no alternative prizes or cash substitutes. The Prizes are non-transferable. Obtaining time off work and/or study or related activities to participate in a Competition and/or take a prize will be the sole and absolute responsibility of each entrant.
The prize consists of (i) flights, accommodation and excursions only up to a maximum of £4,000. In the event that the above elements of the prize amount to below the total prize amount, the remainder will not be provided in cash. Any other costs (ii) holiday prizes do not include airport departure or government taxes (these must be paid by the prizewinner and any travelling companion), and (iv) insurance is not provided as part of any holiday prize. It will be each prizewinner’s and their travelling companion’s responsibility to take out at their own cost all relevant insurance (including but not limited to health and travel insurance, insurance for theft, loss and damage to property) which may be required or prudent to be taken. All other costs and expenses in taking up the prize not set out in the stated prize description will be at the winner’s expense, these include but are not limited to transfers to the airport, meals, drinks, spending money, gratuities. A valid passport / visa / tourist card is the responsibility of the winner and guests. Any cost associated with acquiring a passport / visa / tourist card is the responsibility of the winner and guests.
It is the responsibility of the prizewinner and travelling companion (if applicable) to check any travel advisories issued by the Government and determine whether they wish to accept the risk of travelling to the destination. Taster will not be responsible for any loss or damage suffered by any prizewinner and their travelling companion (if applicable) arising out of their failure to follow any travel advisories issued by the Government.
Taster will not be liable or responsible for any loss or damage suffered by any prizewinner or their travelling companion (if applicable) should any prizewinner or their travelling companion (if applicable) not redeem a holiday prize as a result of any Government travel warning or advisory applicable to the destination country and/or countries or for any other failure on their part to travel. In particular, we shall have no obligation to substitute any alternative prize, cash equivalent or other compensation where a prizewinner and/or their travelling companion (if applicable) fail to redeem the prize for any reason.
Unclaimed or declined Prizes
If a prize is declined or if a winner forfeits the prize under these General Terms, then Taster may at its absolute discretion draw an alternative winner.
All prizes must be claimed by responding to Taster’s direct message within ten (10) days of our notification of winning unless otherwise stated. We reserve the right to award prizes unclaimed after this period to alternative prizewinners or not to award them at all and we shall have no liability in respect of the entry initially selected.
Cancellation of Competition
Taster reserves the right to vary these terms and conditions or cancel the Competition at any stage in the event of circumstances arising beyond its reasonable control.
Publicity and Personal Information
The personal information supplied by entrants when entering the Competition or requested by Taster, will be used by us in accordance with the Data Protection Act 2018 and Taster’s Data Security and retention Policy (available here). You should always read the data policy as your entry in the Competition is an agreement to be bound by the privacy policy. All entrants may have their details removed from Taster’s database by contacting us. If details are removed prior to the conclusion of the Competition and/or award of prize(s), entrants will however forfeit their right to claim any prizes.
Should an entrant be required to submit a third party’s personal information as a part of entry into or participation in the Competition, each entrant must ensure that any other person whose details have been provided by the entrant to us has given or will give their consent for their details to be provided to Taster and to be contacted by us in relation to the Competition.
It is a condition of your entry to the Competition that Taster has the right to publicise to the public the names and Counties of entrants to the Competition and otherwise to process your personal information for the running of the Competition and matters incidental to the Competition.
No fees shall be payable to any entrant in relation to their entry in any Competition or any publicity relating to the Competition.
By entering the Competition entrants warrant and undertake that the information submitted is true, accurate and complete.
Exclusion of Liability
Except as specifically set out herein and to the maximum extent permitted by law, all conditions, warranties and representations expressed or implied by law are hereby excluded.
To the fullest extent permitted by law, we hereby exclude and shall not have any liability to any entrant or prizewinner in connection with or arising out of any Competition howsoever caused, including for any costs, expenses, forfeited prizes, damages and other liabilities, provided that nothing in these General Terms shall operate so as to limit or exclude our liability for personal injury or death caused by our negligence. For the avoidance of doubt, this paragraph shall also apply in respect of any prize provided by a third party provider and to any social networking site (where the Competition is hosted by a social networking site).
Where a competition is hosted by a social networking site, the Competition is in no way sponsored, endorsed, administered by or associated with that social networking site.
By entering the Competition, the entrant indemnifies us against any and all actions, claims, damages, expenses or liabilities suffered or incurred directly or indirectly by us in consequence of any breach or alleged breach, non-performance or non-observation by the entrant of any agreement, conditions, obligation or warranty on the part of the entrant herein.
In the event that any provision of these General Terms are held to be illegal, invalid, void or otherwise unenforceable, it shall be severed from the remaining provisions which shall continue in full force and effect.
Applicable law and competent jurisdiction
English law applies and the English courts shall have exclusive jurisdiction over any proceedings in connection with this promotion.
